CODE OF CONDUCT

Who is a building expert witness?
An expert witness is a person with a depth of knowledge of the building industry, regulations, Codes and requirements to build and complete a structure to an acceptable standard.
Who will need a building expert?
Persons, including builders, owners, owner’s corporations, that have a problem or defect within a building or property and require support in litigation to substantiate that claim. Where litigation is not undertaken, then the expert can provide solutions to building defects and problems.
Expert Code of Conduct
All reports must be completed with an over-riding duty to the Courts or CTTT and not to the person retaining an expert. Reports are to be completed in accordance with Schedule 7 – Expert Code of Conduct, June 2005 and must be signed to agree with the binding terms.
A building expert witness is a person with extensive specialist expertise and can provide technical support on construction defects and building problems. Litigation support is provided in claims or matters before the Court, Fair Trading or CTTT. The expert will provide documentation on compliance with various building codes, Australian Standards as well as building standards and tolerances. Claims for sub-standard pre-purchase building and pest inspections can also be included. The expert is required by the Courts to comply with the Expert Code of Conduct.
